TERMS AND CONDITIONS
1. Acceptance of Terms
By accessing, browsing, or purchasing from BOBS Auto Services (“we,” “our,” “us”), you (“customer,” “you,” “your”) agree to be bound by these Terms & Conditions, our Warranty Policy, Return & Refund Policy, and Shipping Policy (collectively, the “Agreement”). These Terms apply to all purchases made through our website, by phone, or by email. If you do not agree, do not use our site or place an order.
2. Eligibility
You affirm that you are at least 18 years old and legally capable of entering into binding agreements. Transactions made on behalf of organizations or repair shops must be authorized by the entity’s representative.
3. Electronic Consent
By placing an order or communicating electronically, you consent to receive all contracts, disclosures, and communications electronically under the U.S. E-SIGN Act. Such electronic acknowledgments and approvals carry the same legal weight as signed written agreements.
4. Use of the Website
You agree not to use the website or our communication channels for unlawful activity, to upload harmful content, or to interfere with site functionality. Unauthorized scraping, bots, or attempts to access other accounts are prohibited.
5. Product Information & Representations
- All parts sold (engines, transmissions, drivetrains, etc.) are used OEM or remanufactured unless stated otherwise.
- Mileage, condition, and compatibility are verified to the best of our ability based on customer-provided information. Normal wear and corrosion are expected in used parts.
- Photos and listings may use sample images; the shipped unit will match specifications but may differ cosmetically.
- The buyer is solely responsible for confirming VIN, engine code, transmission ID, emission type (Federal/California), and drivetrain (2WD/4WD/AWD).
- We rely entirely on buyer-supplied data; any misidentification or omission voids related claims or refunds.
- Availability and pricing are subject to change without notice.
6. Order Verification & Right to Cancel
- Unavailable parts or failed inspection,
- Typographical or pricing errors,
- Failed payment authorization, suspected fraud, or unverifiable address, or
- Unsafe or undeliverable shipping destination.
If we cancel your order before shipment, funds collected (excluding merchant fees) will be refunded.
7. Pricing, Payment & Non-Payment
- Prices are in U.S. Dollars (USD).
- Accepted methods: major credit/debit cards, Affirm, PayPal, wire transfer, and approved financing.
- Sales tax is collected where applicable.
- Merchant processing fees (Visa, Mastercard, PayPal, Affirm, etc.) are non-refundable.
- Orders financed through Affirm or third parties are subject to their terms.
Default or Non-Payment: Returned payments, reversals, or unpaid balances accrue 1.5% monthly interest (18% annual) or the maximum allowed by law. You are responsible for all collection costs, including attorney and agency fees.
8. Shipping & Delivery
- Free shipping applies to business/commercial addresses within the continental U.S.
- Residential, liftgate, limited-access, or appointment deliveries may incur carrier surcharges.
- Standard delivery time is 7–10 business days after confirmation; delays may occur.
- Buyer (or receiving party) must inspect shipments before signing. All damage or mismatch must be noted on the Bill of Lading and reported to [email protected] within 48 hours.
- Once signed or marked “Delivered,” risk of loss transfers to the buyer.
- Installing or modifying the part constitutes acceptance of its condition.
- Deliveries to repair shops or third-party receivers are deemed accepted on your behalf.
- We are not responsible for carrier delays, missed appointments, or events beyond our control.
Export Compliance: Products are intended for U.S. installation only. You agree not to export or transfer any part in violation of U.S. export or emission laws.
9. Returns, Refunds & Restocking
- All returns require an RMA number within 10 days of delivery. Unauthorized or late returns may be refused.
- Parts must be unmodified, drained, and secured on a pallet.
- Refunds apply to part cost only and exclude freight, merchant fees, and restocking.
- Restocking Fee: 25% applies to all authorized returns and refused deliveries.
- Round-trip freight is non-refundable.
- Refunds process within 5–10 business days after inspection.
Pre-Shipment Cancellations: Orders cancelled after photos are shared or preparation begins are subject to handling and merchant fees. Orders cancelled within 24 hours may receive a full refund minus merchant fees if unprocessed.
10. Core Returns
- If applicable, cores must be returned within 15 days of delivery.
- Must be complete and rebuildable.
- Refund issued within 10 business days of verified inspection.
11. Installation Requirements
Warranty eligibility requires installation by a licensed repair facility following OEM standards. Failure to follow these steps voids warranty coverage.
- Replace all seals, gaskets, filters, fluids, and belts.
- Flush all cooling and transmission systems.
- Replace timing components, water pump, and torque converter (if applicable).
- Confirm VIN and compatibility before installation.
- Maintain installation invoices, photos, and diagnostic proof.
12. Warranty, Inspection & Claim Procedure
- Coverage applies only to internal lubricated components as stated in our Warranty Policy.
- Do not uninstall or disassemble parts without written authorization.
- BOBS may request inspection or third-party verification.
- Failure to cooperate or provide access voids claim eligibility.
- Replacement or refund does not restart the warranty period.
13. Disclaimer of Implied Warranties
Except as expressly stated in writing, products are sold “AS IS” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Some states restrict this limitation; it applies to the fullest extent permitted by law.
14. Limitation of Liability
BOBS Auto Services’ total liability shall not exceed the purchase price or cost of replacement. We are not responsible for labor (unless covered under Extended Warranty), towing, rental, diagnostics, downtime, or incidental or consequential loss.
15. Customer Cooperation & Dispute Integrity
You agree to provide documentation (delivery proof, photos, diagnostics) before filing disputes or chargebacks. False, incomplete, or bad-faith chargebacks breach this contract. We retain all evidence for bank and legal defence.
16. Privacy & Data Security
We collect only information required to process and deliver your order. We do not sell or rent personal data.
Data Security: We employ reasonable administrative and technical safeguards. In the event of a data breach, we will notify affected customers as required by applicable law.
17. SMS Services (TCPA & CTIA Compliance)
By opting in, you agree to receive order updates via SMS. Message/data rates may apply. To opt out, reply “STOP.” For help, reply “HELP.” We do not share phone data with third parties. We comply with TCPA, CTIA, and The Campaign Registry (TCR) standards.
18. Intellectual Property
All website text, photos, product listings, and trademarks are the exclusive property of BOBS Auto Services or licensors. You may not reproduce, modify, or distribute our content without written permission.
19. Force Majeure
We are not liable for delays or non-performance caused by events beyond our reasonable control, including natural disasters, strikes, acts of government, carrier failure, or supply interruptions.
20. Governing Law, Time Limits & Arbitration
This Agreement is governed by the laws of California, USA. Any dispute will first be submitted to mediation or arbitration under AAA rules in Los Angeles County, California.
Time to File Claims: Any claim or cause of action must be filed within one (1) year of purchase or it will be permanently barred.
Attorney’s Fees: The prevailing party in any dispute arising under these Terms shall recover reasonable attorney’s fees and costs of enforcement.
21. Non-Transferability & No Third-Party Beneficiaries
All rights and warranties apply solely to the original purchaser and the vehicle identified on the invoice. No third party (including installers, insurers, or end-users) shall have any rights or remedies under this Agreement.
22. Assignment
BOBS Auto Services may assign or transfer its rights and obligations to a successor or affiliate without notice. The customer may not assign rights under this Agreement without written consent.
23. Severability
If any clause is found invalid or unenforceable, the remaining provisions shall remain in full force.
24. Entire Agreement & Policy Updates
These Terms, together with our Warranty, Shipping, and Refund Policies, form the complete and exclusive contract between BOBS Auto Services and the purchaser. We may amend or update these Terms at any time. The version effective on the purchase date governs that transaction.
